Most civil disputes have an identifiable origin and most can eventually be resolved.   Even where disputes are taken into a court of law for resolution, it is a fact that more than 90% of all commercial litigation is resolved short of a trial.  Even the most hardened litigation positions can be altered as the facts on both sides of a dispute are developed during the legal discovery phase.  Effective dispute resolution requires varying combinations of attention to detail, project management, strategic thinking, aggressiveness, follow through, risk assessment, procedural skill and legal knowledge. 

Dispute Avoidance / Risk Management Counseling

  • Contract review, negotiation and drafting to properly and clearly allocate risks to the parties, insurance carriers and other third parties

  • Advice concerning proper structure of dispute resolution clauses including sophisticated provisions for differential mediation, arbitration and litigation of different types of disputes that may arise out of a contractual relationship
